Introduction and Scope

Welcome to tdscity.com (hereinafter referred to as the "Platform", "Company", "we", "us", or "our"). This Privacy Policy governs the collection, processing, storage, and disclosure of information by tdscity.com. We provide a cloud-based Enterprise Resource Planning (ERP), Customer Relationship Management (CRM), Multi-Level Marketing (MLM) management, and Facility Management (FMC) software-as-a-service (SaaS) solution tailored for real estate developers, builders, brokers, and agencies.

By accessing our website, subscribing to our services, or utilizing our software, you agree to the terms outlined in this Privacy Policy. If you do not agree with these terms, you must immediately cease the use of our Platform.

Critical Legal Distinction: Data Controller vs. Data Processor

To ensure complete legal clarity and compliance with applicable data protection laws, including the Digital Personal Data Protection Act (DPDP Act), General Data Protection Regulation (GDPR), and other global privacy frameworks, tdscity.com strictly operates as a Data Processor.

Our clients (the real estate developers, agencies, and businesses subscribing to our SaaS platform) are the Data Controllers. They determine the purpose and means of collecting data from their employees, sales agents, and property buyers. We merely provide the technological infrastructure to process and store this data upon their direct instructions. If you are an end-customer, sales agent, or employee interacting with tdscity.com through one of our subscribed clients, your data is owned and legally controlled by that respective client organization.

1. Definitions

  • "Client" refers to the business entity, real estate developer, or agency that has subscribed to the tdscity.com software.
  • "End-User" refers to the Client’s employees, administrative staff, field agents, network marketing associates, and property buyers whose data is entered into the Platform.
  • "Client Data" refers to all information, including personal and financial data, uploaded, entered, or generated by the Client and their End-Users within their dedicated Platform workspace.
  • "Platform Data" refers to telemetry, analytics, and usage logs collected automatically by us to ensure the security, maintenance, and operation of the software.

2. Information We Collect

Due to the highly complex and financial nature of real estate transactions, property management, and MLM commission distributions, our software is designed to process extensive and sensitive data points.

A. Information Collected Directly from Clients (Account Setup)

  • Corporate identity details (Company name, registered address, GST/Tax ID).
  • Authorized administrative contact information (Names, corporate email addresses, phone numbers).
  • Billing and payment information (Processed securely via third-party PCI-compliant gateways).

B. Information Processed on Behalf of Clients (Client Data)

  • Identity and KYC Data: Identification numbers, profile photographs, digital signatures.
  • Financial and Transactional Data: Bank account details for payouts, cheque numbers, EMI payment schedules.
  • Property and Inventory Data: Land bank details, unit measurements, maintenance records.
  • HR and MLM Network Data: Attendance logs, 10-level deep network trees, performance statuses.

3. How We Use the Collected Information

We use the information we collect strictly to operate, secure, and improve the tdscity.com Platform.

  • To authenticate users and enforce Role-Based Access Control (RBAC).
  • To execute core features like inventory locking and MLM commission calculations.
  • To process background tasks like late fee penalties and automated payment reminders.

4. SaaS Multi-Tenant Isolation & Data Security

Cryptographic Isolation: Every Client account is assigned a unique Company Session ID. Database queries are architecturally constrained to only return data matching that ID.

Data Encryption: All data transmitted is encrypted using TLS/SSL protocols. Sensitive points at rest, like passwords, are securely hashed.

5. Data Sharing and Disclosures

We treat Client Data with the utmost confidentiality. We do not sell or rent your data. Sharing only occurs with sub-processors (hosting/SMS gateways) or as required by law (TDS reporting/court orders).

6. Data Retention and Destruction

Data is retained during active subscriptions. Upon termination, a 30-day grace period is provided for export, after which a permanent "Data Wipe" is executed to irreversibly delete all Company ID-linked records.

7. End-User Rights (DPDP, GDPR)

As we are the Processor, End-Users (agents/buyers) must direct requests for access or deletion to the Client (Developer/Agency) who acts as the Data Controller.

8. Cookies and Tracking Technologies

We use session, security, and preference cookies strictly for functional operations. Disabling them will render the dashboard and ERP systems inoperable.

9. Children's Privacy

The Platform is for enterprise business use only. We do not knowingly collect information from individuals under the age of 18.

10. Changes to This Privacy Policy

We reserve the right to update this policy. Material changes will be notified via the Platform dashboard or administrative emails.

11. Limitation of Liability Regarding Data

We are not liable for data loss caused by factors outside of our control, including Client negligence (password sharing) or ISP failures.
